Terms of Service
These Terms apply to business and professional customers using the website or services coordinated by Jeton Consolidator.
1. Scope and business documents
Services may include sourcing, sampling, inspection, customization, warehousing, 3PL fulfillment and transportation. The accepted quotation, purchase order, service order, transport document and separate agreement define the specific scope, price and allocation of responsibility.
2. Customer obligations
The customer must provide complete and accurate product, value, quantity, compliance, dangerous-goods and delivery information, and must hold all rights required for the goods, branding, packaging and sale.
3. Warsaw System and Montreal Convention
For qualifying international carriage by air, carrier liability is governed by the mandatorily applicable Warsaw Convention and its amending or supplementary instruments. Where the Montreal Convention 1999 applies, it prevails. Any mandatory convention prevails over conflicting contractual language.
Jeton Consolidator is not automatically the actual air carrier. Contracting and actual carrier status is determined by the air waybill, booking record and applicable convention.
4. Loss, damage, delay and liability limits
Convention liability for cargo loss, damage or delay is generally weight-based and subject to the applicable limit. It does not automatically cover resale value, expected profit or consequential loss. A higher value requires a timely special declaration of interest, any required surcharge and carrier acceptance before shipment.
5. Notice and time bar
Cargo must be inspected on receipt and written notice given without delay. Under Montreal Convention 1999, cargo damage notice is generally due within 14 days after receipt and delay notice within 21 days after the cargo is placed at the consignee’s disposal. Other Warsaw System instruments may prescribe different periods.
A claim against an air carrier is generally subject to a two-year extinguishment period calculated under the applicable convention. Our operational claim deadline may be shorter to preserve recourse rights.
6. Payment, prohibited goods and limitation
Orders proceed after payment or approved credit terms. We may reject unlawful, infringing, sanctioned, dangerous or improperly declared goods. To the extent permitted by law, indirect and consequential loss is excluded, without limiting liability that a mandatory convention does not permit the parties to exclude.
